PRIVACY POLICY

This Privacy Policy describes how RevHERO collects, receives, uses, stores, shares, transfers, and processes Your Personal Data and Client Data in connection with your use of the RevHERO Services, our website, or any other sites or services that link to this Privacy Policy.

For the purposes of this Privacy Policy, these Definitions apply:

“Account” means the primary means for accessing and using all RevHERO Services.
“Affiliates” means any legal entity controlled by, or under common control, with a party to this Agreement.
“Agreement” means these Terms of Service and any links therein.
“Client” means a natural or legal person or entity who has accepted these Terms with RevHERO by using the RevHERO Services.
“Client Data” means data of any kind (images, spreadsheets, text files, etc.) and any other digital data and information put on, inserted and/or used on the Platform by the Client. Client Data shall not contain Sensitive Information.
“Company”, “We”, “Us”, “Our” means RevHERO LLC.
“Content” means any data and information available through or inserted on the RevHERO Services or contained within the structure of the RevHERO Services, including but not limited to sales materials, articles, brochures, presentations, pictures, images, audiovisual works, or other informational materials.
“Cookies” are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website, among other uses.
“Data Processing” or “Processing” means how RevHERO processes Client Data. When providing the Services, RevHERO may collect, process, and gain access to Personal Data of individuals via a Client’s use of Our Services. From a data protection perspective, Client will be the Data Controller, and RevHero will be the Data Processor.
“Device” means any device that can access the RevHERO Services or RevHERO web site such as a computer, cell phone or digital tablet.
“Feature” means a function or set of functions providing a particular capability within the RevHERO Services as determined by RevHERO and as further governed by any applicable Supplemental Terms which may be added from time to time, as needed.
“Feedback” means any comment, bug report, feedback, suggestion or modification for the RevHERO Services which Client or a User provides to RevHERO.
“Personal Data” means any information relating to an identified or identifiable individual where such information is contained within Client Data and is protected similarly as personal data, personal information or personally identifiable information under all applicable Data Protection Laws.
“Platform”means the RevHERO sales automation platform, including any associated Features.
“RevHERO” means RevHERO LLC.
“RevHERO Materials” means the visual interfaces, graphics, design, systems, methods, information, computer code, software, services, “look and feel”, organization, compilation of the Content, code, data, and all other elements of the RevHERO Services.
“RevHERO Services, Services” means the Web Site, Content, RevHERO Materials, Platform and all other content, services and/or products, and Features, available on or through the RevHERO Platform.
“Sensitive Information” means credit or debit card numbers; financial account numbers or wire instructions; government issued identification numbers (such as Social Security numbers, passport numbers), biometric information, personal health information (or other information protected under any applicable health data protection laws), personal information of children protected under any child data protection laws, and any other information or combinations of information that falls within the definition of “special categories of data” under GDPR or any other applicable law relating to privacy and data protection.
“Terms” means the Terms of Service and consists of the General Terms, and the Privacy Policy.
“Third Party Service Provider” refers to third-party companies or individuals employed by the Company who processes data on behalf of the Company, facilitates the Services, provides the Services on behalf of the Company, performs services related to the Services or assists the Company in analyzing how the Services are used.
“User” means any individual accessing or using the Plan or RevHERO Services.
“Usage Data” refers to data collected automatically, either generated by the use of the Services or from the Service infrastructure itself (for example, the duration of a page visit). It may also include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

“Website” means the compilation of all web documents (including images, php and html files) made available via  www.RevHERO.io, its subdomains or domains with identical names under other top domains, and owned by RevHERO.

“You”, “Your” means the individual accessing or using RevHERO Services.

POLICY DETAILS

By using the RevHERO Services, You agree to the collection and use of information in accordance with this Privacy Policy. If You do not agree with this Privacy Policy, You should not use our websites, products and services, or any other sites or services that link to this Privacy Policy. By uploading Client Data to the RevHERO Services, Client authorizes RevHERO to process both Personal Data and Client Data.
RevHERO will maintain administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of both Personal Data and Client Data. Those safeguards will include, but will not be limited to, measures for preventing unauthorized access, use, modification or disclosure of Client Data. Additionally, RevHERO shall only access, use, modify or otherwise disclose Personal Data or Client Data to provide the RevHERO Services, to prevent or address service or technical problems, as compelled by law, as Client or User expressly permits in writing, or as stated in this Privacy Policy.

Collecting and Using Your Personal Data

We use Your Personal Information to provide the services you’ve requested, create and maintain Your accounts, and keep an eye out for unauthorized activity on your accounts. We also use it to communicate with You about the products you’re currently using, your customer support requests, new products you may like, chances for you to give us feedback, and policy updates. We analyze the information we collect to understand user needs and to improve our Websites and Services.
We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include but is not limited to Your Email address, First and last names, phone number; and Usage Data, which is collected whenever you use the RevHero Services.
When You access RevHERO Services by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

What We Share with Third Party Service Providers

Client Data and Personal Data is only shared with Third Party Service Providers or affiliates used to support the RevHERO Services. For example, we use third party service providers for application development, marketing, sales, customer support, and data hosting. These service providers are prohibited from using your Personal Data or Client Data except for these purposes, and they are required to maintain the confidentiality of this information. In all cases where we share information in this way, we explicitly require the third party service providers to acknowledge and adhere to our privacy and data protection policies and standards.


RevHero Services also shares text data and email data, including Client Data and Personal Data, with Artificial Intelligence (AI) models, both ones RevHero builds and AI we utilize in order for our Services to work efficiently. 


Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on the RevHERO Services, store certain information, and to improve and analyze the RevHERO Services. Some of the technologies We may use include:
Web Beacons. Certain sections of our Services and our emails may contain small electronic files known as web beacons (sometimes referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).
Clear gifs or Pixels. We use clear gifs or pixels in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.
Google API’s. Revhero’s use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.
Cookies or Browser Cookies. A cookie is a small file placed on Your Device when you visit a website. When you visit the site again, the cookie allows that site to recognize your browser. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of the RevHERO Services. Some of the Cookies We may use, unless You have adjusted Your browser setting so that it will refuse Cookies, are:
  • Essential website Cookies which are necessary to provide you with Our RevHERO Services and enable you to use Our Features. They help to authenticate users and prevent fraudulent use of user accounts. Without these Cookies, the services that You have asked for cannot be provided, and We only use these Cookies to provide You with those services.
  • Persistent Cookies. These Cookies allow us to remember choices You make when You use the Website, such as remembering your login details or language preference. The purpose of these Cookies is to provide You with a more personal experience and to avoid You having to re-enter your preferences every time You use the Website.

RevHERO’s Rights to Data

RevHERO may use all Personal Data and Client Data for research, sales, education, marketing, and other similar purposes. Client also grants RevHERO the right to use and analyze aggregate system activity data associated with use of the RevHERO Services by Client and its Users for the purposes of optimizing, improving or enhancing the way the RevHERO Services operate, and to create new Features and functionality in connection with the RevHERO Services in the sole discretion of RevHERO.
RevHERO Clients may collect, manage and process Personal Data and Client Data when using RevHERO Services. When Clients or Users use the RevHERO Services, You are entrusting that data to Us for Data Processing. We may use this data to:
  • To communicate with You (such as through email, phone call, text or other equivalent forms of electronic communication) about products that you have downloaded and services that you have signed up for, changes to this Privacy Policy, changes to our Terms of Service, or other important notices.
  • To set up and maintain Your account, and to do all other things required for providing our services, such as enabling collaboration, providing website and email hosting, and backing up and restoring Your data.
  • To send You transactional emails or notifications about Your account management, billing, payment method, or Your Plan.
  • To provide customer support and resolve technical issues, and to analyze and improve our interactions with Clients.
  • To understand how users use our products and services, to monitor and prevent problems, and to improve our products and services.
  • To detect and prevent fraudulent transactions and other illegal activities, to report spam, and to protect the rights and interests of RevHERO, RevHERO’s users, third parties and the public.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or inquired about unless You have opted not to receive such information by unsubscribing to same.
  • To update, expand and analyze our records, identify new customers, and develop and improve our products and services. We track trends occurring in the usage to help Us determine what new features, functions, improvements or integrations would be helpful to our Clients and/or put into development and to monitor and improve marketing and sales campaigns.
We may also record, analyze and use your interactions with us, including email, telephone, and chat conversations with our sales and customer support teams, for improving our interactions with you and other Clients.
We may also collect information that Your browser sends whenever You use the RevHero Services or visit Our website or when You access the RevHERO Services or visit Our website by or through a mobile device.

Retention of Your Data

The Company will retain all Personal Data and Client Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use all Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal Agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Data

Personal Data and Client Data may be transferred to, and maintained on, computers located outside of Your county, state, province, country or other governmental jurisdiction where the data protection laws may differ from those in Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Legalities / Disclosure of Data

RevHERO takes the security of all Personal Data and Client Data seriously. That said, it’s important to remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While RevHERO strives to use the best commercially acceptable means to protect all Data acquired through the RevHERO Services, We cannot guarantee its absolute security. This is why we stress that no Sensitive Information be uploaded to our Platform.
The Company may disclose both Personal Data or Client Data if required to do so by law, subpoena, court order or other legal process, or if we believe that disclosure is necessary to protect your safety, the safety of others, investigate fraud, or protect our rights.
We may disclose Personal Data or Client Data to a third party if we believe that such disclosure is necessary for preventing fraud, spam filtering, investigating any suspected illegal activity, enforcing our Agreements or policies, or protecting the safety of our users.
We may share Your Personal Data and/or Client Data with Service Providers to monitor and analyze the use of our Service, to contact You, or to offer You certain products, services or promotions. However, We will never sell Personal Data or Client Data to a third party for advertising purposes.
If RevHERO is involved in a merger, acquisition or asset sale of all or a portion of Our business to another company, Your Personal Data or Client Data may be transferred. We will provide notice if this transfer becomes subject to a different Privacy Policy. We may use Personal Data or Client Data to also evaluate a merger, divestiture, or other business restructuring.

Children’s Privacy

RevHERO’s Services are not to be directed to anyone under the age of 16. Clients using our products, however, may inadvertently collect information about or from children. If you process information relating to children, you acknowledge and agree that you will be responsible for complying with all applicable laws and regulations related to the protection of such personal information.
We do not knowingly collect personally identifiable information from anyone under the age of 16. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 16, We will take steps to remove that information from Our servers.

California

The California Consumer Privacy Act (“CCPA”) requires businesses to disclose whether they sell Personal Information. RevHERO is a business and does not sell Personal Information. We may share Personal Information with authorized service providers or business partners who have agreed to our contractual limitations as to their retention, use, and disclosure of such Personal Information.

Links to Other Websites

RevHERO Service’s may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third party’s site. We strongly advise You to review the Privacy Policy of every site You visit. RevHERO has no control over and assumes no responsibility for the content, privacy policies or practices of any third-party sites or services.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the “Last updated” date at the top of this Privacy Policy.
Prior to any changes becoming effective, We will let You know via email and/or via a prominent notice on our website when changes will occur to our Privacy Policy.
